Hmm, I'm gonna put the copyright URL here for those of you who seem to not know what copyright is. Let me say here, in my own little diary space that "fair use" is using something to quote it to review or send people to the original...it does not mean "using it for my diaryland space cuz it's my personal space"...your diaryland space is not your personal space, though it may feel like it is. It is a public webpage every bit as much as a yahoo or geocities space. Also this hookey about "i'm not using it for profit". Hellooooo... every library poster I've ever drawn, the comic book I did for St-Joseph's Oratory, a book cover for Ste-Justine's Hospital, a T-shirt for Greenpeace, reports to the stockholders of huge companies... all these are not for profit. And you know what... they commission my work, or if they reprint it THEY PAY ME!!!
This is how artists get their money. If you could find their stuff all over for free, WHY would you BUY it? If you were a hospital, or a church or a school... why would you ever pay any artist, if you could just go out and photocopy their stuff and use it, and drag and drop on the Internet? NO... it is COPYRIGHT the ARTIST or his ESTATE, until he signs it over. That means WRITTEN SIGNATURE. If an artist creates something, and has it on a website that says, I have copyright, and anyone may use this... then THAT is written permission.
FAIR USE Is using a portion of the work without changing it for PARODYING, REPORTING ON (ie news and reviews), or RESEARCH or EDUCATING ABOUT the copyrighted work.. and you STILL have to credit it... much like you have to write your sources when you write a paper in school. You have to say WHAT it is, WHO did it. FAIR USE is NOT using it on a poster, a button, a website. It IS, if you write your entry about an artist, scan in one image, credit the image with a copyright notice to his name, and tell people where to get his stuff, and what the book titles are, for instance. Like a review in the paper. That is fair use.. you are using THAT persons' stuff to promote the same stuff... and giving an example to the public. NOT using his stuff to promote your band, your company, your website or your name.
If you DONT have written permission, I dont give a shits ass if you LIKE it, or RESPECT the artist (no, you do NOT if you steal his work), or if you think it is FAIR because it is a little button, or your diaryland template.
If they ever felt like it they could complain and have your site deleted, because pretty much every server or host site I have seen has a list of rules, and that includes NOT fucking with COPYRIGHT.
And yeah, you can decide that you think that this is all a bunch of bullwackey, and you can download images like you download MP3s or whatever. Well, if it is there, for you to download with permission, then great. But if you are putting it as the button for your ring, or your website, or whatever... that is NOT your personal use. You are using that image to advertise yourself to the public... you are PUBLICLY distributing it. Personal use is sticking it on your desktop where only you see it. Personal use is making a photocopy to stick over your bed. I of course have copied on cassette tape music that I like. But I play it at home. I dont make copies of it that I give out to advertise my website or my art, and I dont put it on my webpage.
And hey, so if you hear some artist has said it's cool to use their images as a poster... well CONTACT them and find out if it is cool for you to use it for your button or ring or whatever. You know what... they are probably real people, and will probably say yes!! Unless they don't like your ring.
You know I would be totally burned if someone used an image I drew, and used it for some Christian Right or Traditional Family ring button. I dont give a fuck if I said that genderfuck performing artists can use it. I would be totally peeved for the public to say "oh there is that artist who does the "Christian Right Traditional Family" logo". I turn down such contracts for a reason... and if I wont do it for pay, I dont want them to take it for free. I don't want MY artwork, my name and my reputation associated with things I don't want.
Go pick on "Killer" Coke, or Pepsi or some other company fucking over the world. Dont fuck with artists, who usually live under the poverty level til they die, unless they have rich relatives or dentist husbands. (No that is not a jibe at Lynn Johnston, and she WAS nice enough to write me back once when I emailed her)
I dont give a fuck if you like the artist. If you DO like the artist, you should respect their shit, and actually do them a service to send them a copy of pages, posters etc you see their stuff on. They may be happy to get it, and happy to see that people like their stuff, and will use it in their portfolio of where there stuff is printed. Or they may hate it, and they can take measures to get their stuff respected. But it is THEIR stuff, unless you have written transfer of copyright. And if they say yes... CREDIT them!! YOU didnt make that gorgeous image... they did. Let people know their name, so that that person will know who is the artist, and can seek out the artist's work and buy it too If they want.
These are INTERNATIONAL LAWS. And they are there for a reason. So click on at least one of the links (which are all the same URL by the way) and educate yourselves. If you're gonna be thieves, at least you cannot plead ignorance.

I know I want to put up cool pics of every fuckin great artist I know... and I know many.. both personally and professionally... not to mention all those I admire and have admired since childhood.
But I dont fuck with THEIR shit, cuz I dont want people to fuck with mine.
And let that be a notice to you. If anyone asks me for permission to use an extract of one of my drawings I probably will say yes (unless you are the Christian Right or Traditional Family shits), but if I find ANYONE, friend or otherwise, who is using my drawings or photos without telling me or asking me, I will REPORT them. Got it?? No fuck with the shit... no problemo.... fuck with the shit... big problemo.
